An Independence Day Tradition

Everybody has heard the phrase “As American as baseball, hot dogs and apple pie.” These three things must typify all that is good about America.

I am certain that many Americans will be watching baseball this Fourth of July. I am also certain that many American’s will eat some apple pie. But as far as hot dogs go some Americans will be eating more than the rest.

Legend has it that in 1916 four immigrants in an effort to decide who was the most patriotic decided to stage a hot dog competition. James Mullen won that competition which was held at Nathan’s Famous hot dog stand at Coney Island. He consumed a rather weak 13 hot dogs in 12 minutes. Bigger and better things were to come.

Today Nathan’s International July 4th Hot Dog Eating Contest is held at Nathan’s original restaurant in Coney Island.

For those of us who are not yet familiar with this contest this is serious business.

It will draw tens of thousands of people and hundreds of thousands of people will watch it on ESPN. The mayor of New York is the one who performs the weigh in. These people are not messing around.

The event believe it or not is sanctioned by IFOCE, which stands for the International Federation of Competitive Eating. Can you imagine? Last years winner received the Mustard belt, 10,000 dollars, and a couple cases of hot dogs.

It is an international contest and unfortunately the Japanese have had good luck in recent years. The belt lies in the country of the winner so most of the last decade the belt has resided at the Imperial Palace in Japan. However, an American returned glory to the United States last year by eating a record 66 hot dogs.

By the way this competition underscores another American tradition.

That being the ability to extract profit or make money from virtually anything.

Regular Walking Promotes Independence

Older adults can decrease their risk of disability and increase their likelihood of maintaining independence by 41 percent by participating in a walking exercise program, according to a new University of Georgia study. The study, which appeared in the Journal of Geriatric Physical Therapy, also found that walking program participants increased their peak aerobic capacity by 19 percent and increased their physical function by 25 percent. “In the past decade, researchers have focused on the benefits of strength training in maintaining independence, but until now we didn’t have good evidence using an objective performance measure that a walking program would improve physical functioning,” said study co-author M. Elaine Cress, professor of kinesiology and researcher in the UGA Institute of Gerontology. “Our study found that walking offers tremendous health benefits that can help older adults stay independent.” The researcher program group met three times a week for four months and would walk for 10 minutes continually.

As the weeks progressed, they increased their walking time to 40 continuous minutes. Each session began with a 10-minute warm-up and ended with a 10-minute cool-down that included balance and flexibility exercises. Trudy Moore-Harrison, the lead author of the study, added that walking doesn’t require any special equipment other than a pair of comfortable shoes, which makes it a simple and low-cost way for people to become active. Getting people to stick with exercise programs can be difficult, but the researchers found that every single member of the group stayed with the program for its four-month duration. Implementing strength training activities regularly, can lead to better retirement living. Great senior citizen housing can help create much better living standards for senior independent living with regularly scheduled exercises. “People really enjoyed the program,” said Moore-Harrison. “It gave them an opportunity to make new friends and get to know their neighbors. We know that walking is good for you, but too many people still aren’t doing it,” Moore-Harrison said. “This study shows that just walking on a regular basis can make a huge impact on quality of life.”




Independent Contractor Lawsuit

“Bruce” was an independent landscaper who was often called upon by a larger landscaping contractor to help with big projects. The fact that he was an independent contractor is important because otherwise under New York Law an employee cannot sue his employer because of the workers’ compensation law.

On one job, the task was to remove a large maple tree on a homeowner’s property in Westchester. The team began by cutting off the top of the tree.

The remaining part of the tree was going to fall in an area that was zoned off, which was about 60 feet in radius so there would be plenty of room for the tree to land without incident. A rope was thrown around the branch and the workers pulled it tight toward the sectioned off “zoned” so that the tree would fall in the right direction.

As the tree began to fall, two of Bruce’s co-workers panicked and began running away leaving Bruce with a slackened rope as the tree began to fall “off course”.

Bruce tried to get the tree under control by pulling on the rope himself but as you can guess, the tree won.

Then there was a domino effect: Bruce got out of the way of the Maple tree, but the Maple tree fell onto an Ash tree which then snapped and struck Bruce causing enormous injuries requiring multiple surgeries.

Bruce sued the landscaping company and recovered a substantial amount, given that the accident was a result of lack of control and safety procedures on the site by the company that hired Bruce. If the workers who gave up on Bruce were his co-workers, the best he could have hoped for was whatever he received from workers compensation, which only provides for reimbursement of wages and payment of medical expenses. There is no recovery for pain and suffering under New York workers’ compensation State.
